These Terms of Service (“Terms”) govern your access to and use of the SellerBowl platform operated by SellerBowl LLC (“SellerBowl,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using SellerBowl, you represent and warrant that you meet these requirements.

2. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3. Subscription and Payments

3.1 Plans and Pricing

SellerBowl offers subscription plans with varying features and pricing. Current pricing is displayed on our website and may change with 30 days' notice.

3.2 Billing

Subscriptions are billed in advance on a monthly or annual basis through Stripe. You authorize us to charge your payment method on file for all applicable fees.

3.3 Free Trials

We may offer free trials. At the end of a trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

3.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. See our Refund Policy for details on refunds.

4. Acceptable Use

You agree to use the Service in compliance with our Acceptable Use Policy and all applicable laws. You shall not:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape or extract data from the Service
  • Resell, sublicense, or redistribute the Service without authorization
  • Violate the intellectual property rights of others

The Service, including all content, features, functionality, software, and design, is owned by SellerBowl LLC and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data or content you submit to the Service. By submitting content, you grant us a limited license to use, process, and display it solely to provide the Service.

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation or compensation to you.

6. Third-Party Data and Services

SellerBowl aggregates and analyzes data from third-party marketplaces (Amazon, Shopify, Etsy, TikTok, etc.). We do not guarantee the accuracy, completeness, or timeliness of third-party data. You acknowledge that:

  • Third-party data may be subject to their own terms and conditions
  • Data availability may change without notice
  • Business decisions based on this data are made at your own risk

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELLERBOWL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless SellerBowl LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Houston, Texas, in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Refund Policy, constitute the entire agreement between you and SellerBowl LLC regarding the Service.
